Blastocyst transfer. Discussion of a new law on reproductive medicine

Zusammenfassung Niedrige Schwangerschaftsraten und ein erhöhtes Mehrlingsrisiko sind als Folge der "Dreierregel"
in Deutschland - Weiterkultivierung von nur 3 Zygoten, Entstehung von maximal 3 Embryonen und Transfer am Tag 2
oder 3 - anzusehen. Studien nach standardisierten Kriterien im Ausland belegen, dass die Auswahl der Embryonen aus
einem Pool, das Einsetzen von sequenziellen Medien, die Möglichkeiten der Blastozystenkultur mit Transfer am Tag 5
und PID im Rahmen einer IVF/ICSI-Behandlung die Situation der Patienten erheblich verbessern. Die
Schwangerschaftsrate und Implantationsrate bei Transfer von 1-2 Blastozysten kann signifikant gesteigert und
dadurch das Mehrlingsrisiko (Drillingsschwangerschaft) signifikant gesenkt werden. Die psychische Belastung der
Patienten reduziert sich um ein Vielfaches, da die frühe Abortrate und erfolglose Therapiezyklen minimiert werden.
Aufgrund der vorhandenen und hier aufgeführten Daten wäre eine Änderung des ESchG § 1 (Dreierregelung) für
kinderlose Paare wünschenswert. Alternativ wird vorgeschlagen, in einem neuen Fortpflanzungsmedizingesetz den
Blastozystentransfer zu ermöglichen.
Abstract Article one of the German embryo protection law provides that only three pronucleated oocytes are allowed
to form a cleaving embryo and to be used for further blastocyst cultivation. So far it has not been possible to recognize
those fertilized oocytes which have the potential to grow to the blastocyst stage. Because of chromosomal
aneuploidies, only 40-50 % of early embryos are able to reach this stage. At present, the German situation results in a
relatively low pregnancy rate accompanied by a high risk of multiple pregnancies. Results in other countries show that
by the use of sequential media embryo culture up to the transfer of expanded blastocysts on day 5 is possible. By the
transfer of one or two blastocysts only, pregnancy and implantation rates are at least twice as high as those in
Germany. Furthermore, the risk of multiple pregnancies is decreased considerably. This foreign experience means a
reduction of stress on the patients because pregnancies can be achieved much faster with fewer repetitions of the
therapy. The experience from other countries strongly suggests either a much needed change of article one of the
German embryo protection law or alternatively a new paragraph in a new German reproductive medicine law with
permission for blastocyst transfer. A new law on reproductive medicine should be able to fulfil not only the needs of
the patients but also to continue to protect the legal and moral status of the embryo.
